This website is operated by FLOLAB LLC (“FLOLAB”, “we”, “us”, “our”). By visiting our site and/or purchasing from us, you agree to be bound by these Terms of Service (“Terms”), including additional terms and policies referenced or linked here.

We may update these Terms at any time by posting a revised version on this page. Your continued use constitutes acceptance of changes. Our store is hosted on Shopify Inc., which provides the e-commerce platform we use to sell our products and services.

1. Online Store Terms

You represent that you are the age of majority in your jurisdiction (or have parental consent for minors using the site). You may not use our site for any unlawful or unauthorized purpose. Any breach of these Terms may result in immediate termination of your access.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. Content (excluding credit-card data) may be transferred unencrypted over networks and adapted to technical requirements. Credit-card data is always encrypted in transit. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.

3. Accuracy, Completeness & Timeliness

Site materials are for general information and may not be current or complete. We may modify content at any time without obligation to update. Your reliance on site material is at your own risk.

4. Modifications to Service & Prices

Prices, products, and services may change without notice. We are not liable for modifications, price changes, suspensions, or discontinuations.

5. Products & Services

Some products/services may be available exclusively online and in limited quantities, subject to our Returns & Refunds Policy (link this in Shopify). We make reasonable efforts to display colors/images accurately but cannot guarantee your device’s display. We may limit sales to any person, region, or jurisdiction and limit quantities at our discretion. All descriptions/pricing are subject to change without notice. We do not warrant that the quality of any products/services will meet expectations or that errors will be corrected.

6. Billing & Account Information

We may refuse, limit, or cancel orders at our discretion (e.g., per customer/account/card/address). If we modify or cancel an order, we may attempt to notify you via the contact details provided. You agree to provide current, complete, and accurate purchase and account information and promptly update details to complete transactions and contact you as needed.

7. Optional Tools & Beta Features

We may provide access to third-party tools/features “as is” and “as available” without warranties or endorsement. Use is at your own risk and governed by third-party terms.

8. Third-Party Links

Third-party links may direct you to websites not affiliated with us. We are not responsible for examining or evaluating content and assume no liability for third-party materials, websites, products, or services. Review third-party policies before transactions.

9. User Content; Feedback; UGC License

If you submit ideas, reviews, photos, videos, or other content (“User Content”), you grant FLOLAB a worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works from such User Content in any media, for marketing, support, and operational purposes. You represent you own or control all rights in your User Content and it does not infringe others’ rights or contain unlawful/obscene content. We may monitor, edit, or remove content at our discretion.

10. Personal Information

Your submission of personal information through the store is governed by our Privacy Policy (link to your Privacy Policy page).

11. Errors, Inaccuracies & Omissions

Information may contain typographical errors or omissions (e.g., product descriptions, pricing, promotions, shipping charges, transit times, availability). We may correct and update information or cancel orders if any information is inaccurate at any time without prior notice (including after you submit an order), as permitted by law.

12. Prohibited Uses

In addition to other prohibitions, you agree not to use the site: (a) for unlawful purposes; (b) to violate regulations/laws; (c) to infringe IP rights; (d) to harass or discriminate; (e) to submit false/misleading information; (f) to upload malware; (g) to collect/track others’ personal info; (h) to spam/phish/crawl/scrape; (i) for obscene or immoral purposes; or (j) to circumvent security features. We may terminate use for violations.

13. Disclaimer of Warranties; Limitation of Liability

The Service and all products/services are provided “as is” and “as available.” To the fullest extent permitted by law, FLOLAB disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, durability, title, and non-infringement.
To the maximum extent permitted by law, FLOLAB and its affiliates, officers, employees, and licensors shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or lost profits/revenue/data/use. In no event will our aggregate liability for all claims relating to the Service exceed the greater of US$100 or the amount you paid us in the 12 months preceding the claim.

(Some jurisdictions do not allow certain exclusions/limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.)

14. Indemnification

You agree to indemnify, defend, and hold harmless FLOLAB and its affiliates, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law, or infringement of third-party rights.

15. Force Majeure

We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, labor disputes, supply chain issues, epidemics, war, governmental actions, utility failures, or internet interruptions.

16. Export; Sanctions; Taxes

You must comply with all applicable export control and sanctions laws. You are responsible for any taxes, duties, and fees that apply to your purchases (except those we are required by law to collect/remit).

17. Severability

If any provision is unlawful, void, or unenforceable, that provision is deemed severed and does not affect the validity of remaining provisions.

18. Termination

These Terms are effective unless and until terminated by you or us. We may terminate or suspend access at any time without notice for any breach. Obligations and liabilities incurred prior to termination survive.

19. Entire Agreement; No Waiver; Headings

These Terms and any policies posted on the site constitute the entire agreement between you and us and supersede prior agreements. Our failure to enforce any right is not a waiver. Headings are for convenience only.

20. Governing Law; Dispute Resolution (US)

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, and applicable US federal law.

Binding Arbitration & Class-Action Waiver (US consumers):
Any dispute arising out of or relating to these Terms or your use of the site will be resolved by binding arbitration administered by the AAA under its Consumer Arbitration Rules. You and FLOLAB waive any right to a jury trial and to participate in a class action. You may seek claims in small-claims court if eligible. You may opt out of arbitration within 30 days of your first purchase by emailing hello@flolab.io with subject “Arbitration Opt-Out” and your order number and full contact details.

(If you are located in the EEA/UK, you may have mandatory local rights which are not affected by this clause.)
